Terms of Use

1. Acceptance and scope

These Terms of Use govern your access to and use of the Vervain mobile application and the website vervainapp.com, both operated by AgTechNest Inc. By downloading, accessing, or using Vervain, you agree to these Terms. If you do not agree, do not use the app or website.

Your use of Vervain is also subject to our Privacy Policy and to the terms of the platform from which you obtained the app.

2. Eligibility and accounts

Vervain is not directed to children under 13. If you are under the age of majority where you live, you may use Vervain only with permission from a parent or legal guardian.

You are responsible for maintaining the confidentiality of your account and for activity performed through it. You agree to provide accurate information and to notify us if you believe your account has been accessed without authorization.

3. Limited license

Subject to these Terms, AgTechNest Inc. grants you a limited, personal, revocable, non-exclusive, non-transferable license to install and use Vervain for lawful, non-commercial purposes on devices you own or control, subject to applicable app store usage rules.

You may not copy, sell, sublicense, distribute, modify, reverse engineer, attempt to extract source code, or create derivative works from Vervain except where such a restriction is prohibited by applicable law or permitted by an applicable open-source license.

4. Educational purpose only

Vervain provides educational information about herbalism, plants, traditional uses, folklore, herbal preparation concepts, and history. Vervain does not provide medical advice, diagnosis, treatment, prescriptions, or professional plant-identification services.

Content in Vervain is not a substitute for advice from a qualified healthcare professional, pharmacist, poison-control service, veterinarian, or experienced local plant-identification expert.

5. Plant and health safety

Do not consume, prepare, administer, or otherwise use a plant based solely on information provided by Vervain. Plants may be toxic, misidentified, contaminated, contraindicated, or unsafe because of allergies, pregnancy, health conditions, medication interactions, dosage, preparation, or local environmental conditions.

If you suspect poisoning or a medical emergency, contact emergency services or your local poison-control centre immediately.

6. Purchases and subscriptions

Vervain may offer optional one-time in-app purchases and auto-renewable subscriptions. Available products, benefits, prices, currencies, billing periods, and any trial terms are displayed in the app before purchase.

• Payments are charged through your Apple App Store or Google Play account.
• Subscriptions renew automatically unless cancelled through your platform account settings before renewal, subject to that platform’s rules.
• Deleting Vervain or deleting your Vervain account does not automatically cancel an active store subscription.
• You are responsible for managing or cancelling subscriptions through Apple or Google.
• Refunds, billing disputes, and payment processing are governed by the applicable store’s policies and applicable law.

RevenueCat may be used to validate purchases and determine which premium entitlements are active, as described in our Privacy Policy.

7. Apple and Google platform terms

If you obtained Vervain through Apple’s App Store, Apple’s Standard End User License Agreement applies to your licensed use of the iOS app. These Vervain Terms supplement that agreement.

If you obtained Vervain through Google Play, your use of Google Play, acquisition of the app, and platform-processed purchases are also subject to the Google Play Terms of Service.

8. Acceptable use

You agree not to:

• Use Vervain for unlawful, fraudulent, abusive, or harmful purposes.
• Interfere with the app, website, servers, security measures, or another user’s access.
• Attempt unauthorized access to accounts, systems, or data.
• Use automated means to scrape, extract, or reproduce substantial portions of Vervain content.
• Misrepresent Vervain content as professional medical advice or use it to endanger another person.

9. Intellectual property

Vervain, including its software, visual design, branding, illustrations, text, lessons, quizzes, plant entries, and other original content, is owned by or licensed to AgTechNest Inc. and is protected by applicable intellectual-property laws. These Terms do not transfer ownership to you.

10. Third-party services and links

Vervain may rely on or link to third-party platforms and services. Their availability and conduct are outside our control, and their own terms and privacy policies apply. A link does not imply that AgTechNest Inc. endorses all third-party content.

11. Availability and changes to Vervain

Vervain is provided on an “as available” basis. We may add, modify, suspend, or discontinue features or content, including premium features, where reasonably necessary for operation, security, legal compliance, or product development. We do not guarantee uninterrupted or error-free availability.

12. Suspension, termination, and account deletion

You may stop using Vervain at any time. You may request deletion of your account by following our account deletion instructions.

We may restrict or terminate access where we reasonably believe an account has violated these Terms, created a security risk, abused the service, or must be restricted to comply with law. Provisions that by their nature should survive termination will remain in effect, including intellectual-property, disclaimers, and limitations of liability.

13. Disclaimers

To the maximum extent permitted by applicable law, Vervain and vervainapp.com are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. We do not warrant that herbalism-related or educational content is complete, current, error-free, or suitable for a particular purpose.

Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.

14. Limitation of liability

To the maximum extent permitted by applicable law, AgTechNest Inc. will not be liable for indirect, incidental, special, consequential, or punitive damages, loss of data, loss of profits, or harm resulting from reliance on educational plant information, use of third-party services, or inability to access Vervain.

These limitations do not apply where liability cannot be limited under applicable law, including any non-waivable consumer-protection rights.

15. Governing law

These Terms are governed by the laws applicable in Quebec, Canada, without regard to conflict-of-law principles. This choice does not deprive you of mandatory consumer protections that apply in your place of residence. Platform agreements may specify separate governing-law provisions for matters governed by those agreements.

16. Changes to these Terms

We may update these Terms as Vervain, our practices, or legal requirements change. The latest update date appears at the top of this page. For material changes, we may provide notice in the app or by email when appropriate. Continued use after updated Terms take effect constitutes acceptance where permitted by law.
